Fairly Subscriptions — Merchant terms of service

Last updated: 2026-10-31

These terms govern a merchant's use of Fairly Subscriptions ("Fairly", "we", "us"), a Shopify app that lets merchants sell and manage product subscriptions. By installing Fairly on your Shopify store, you agree to these terms. If you don't agree, don't install or continue using the app.

1. What Fairly does

Fairly lets you create subscription selling plans, gives your customers a self-serve portal to manage their subscriptions, runs a configurable cancellation and retention flow, handles billing and dunning retries via Shopify's Subscription Contracts API, sends lifecycle notifications, and reports analytics on your subscription business.

2. Plans and billing

Fairly is offered on flat monthly plans (Free, Growth, and Scale), billed through Shopify's billing system with no revenue share. Plan limits (active subscriber count, SMS availability) are enforced automatically; you can upgrade or downgrade at any time from the app's Billing page. Charges are processed by Shopify, not by Fairly directly.

3. Data processing

In the course of providing the service, Fairly acts as a data processor on your behalf for your customers' data (subscription details, email, phone, and shipping address where applicable) needed to create, display, and manage their subscriptions, and to send them the transactional notifications described in our privacy policy. We only use this data to operate the features you've enabled — we don't sell it, and we don't use it for advertising.

You remain responsible for your own privacy policy and for having a lawful basis to collect and share your customers' data with apps you install, including Fairly. If a customer of yours contacts us about their data, we'll direct them back to you as the store that controls their relationship with us.

4. Your responsibilities

5. Uninstalling and data deletion

You can uninstall Fairly at any time from your Shopify admin. On uninstall, we process Shopify's mandatory compliance webhooks (customer data request, customer redact, shop redact) to delete or return your shop's data as required. Existing Shopify subscription contracts themselves live in Shopify, not in Fairly, and aren't affected by uninstalling the app.

6. Service availability and changes

We aim to keep Fairly available and reliable but don't guarantee uninterrupted service. We may update these terms or the app's features over time; continued use after a change means you accept the update. Material changes will be reflected here with an updated date.

7. Limitation of liability

Fairly is provided "as is." To the extent permitted by law, we aren't liable for indirect, incidental, or consequential damages arising from your use of the app. Nothing here limits liability that can't legally be limited.

8. Contact

Questions about these terms can be sent to the support contact listed on Fairly's Shopify App Store listing.
